Hyde Park Marketplace – Terms of Service

Welcome to Hyde Park Marketplace (“the Platform”, “we”, “our”).
By creating an account, browsing listings, or posting content on the Platform, you (“you”, “user”, “listing owner”) agree to the following Terms of Service.
1. Nature of the Platform
Hyde Park Marketplace is an online listing platform that allows users to publish and browse housing listings.
We:
- do not own, manage, or operate any rental properties,
- do not verify listing accuracy,
- do not participate in lease agreements,
- do not guarantee the identity or reliability of users,
- do not provide brokerage, real-estate, legal, or financial services.
All listings are user-generated content (UGC).
2. User Accounts
To use certain features, users must create an account and:
- provide accurate information,
- verify their email address,
- keep login credentials secure.
We may suspend or delete accounts that violate these Terms.
3. User-Generated Content (Listings, Photos, Messages)
Users may post:
- property descriptions
- photos
- availability dates
- rental details
- contact information
By posting content, you confirm that:
- you own the rights to publish such content,
- the content is truthful and lawful,
- the content does not infringe any third-party rights.
We reserve the right (but not the obligation) to remove content that is illegal, fraudulent, misleading, discriminatory, or harmful.
4. Platform Is Not a Party to Any Rental Agreement
You agree that:
- all rental transactions occur solely between the listing owner and prospective tenant,
- the Platform is not a party to rental contracts,
- we do not screen, verify, endorse, or guarantee listings, tenants, or landlords,
- the Platform is not responsible for payment disputes, property conditions, background checks, scams, or fraud.
All negotiations, decisions, and agreements are strictly between users.
5. User Communications
The Platform allows users to contact each other.
You agree not to use the messaging system to:
- send spam or unsolicited advertisements,
- harass or threaten others,
- request or share unlawful information,
- conduct fraudulent activity.
We may monitor communications only when required for security, legal compliance, or abuse prevention.
6. Prohibited Activities
Users must not:
- post false, misleading, or fraudulent listings,
- upload copyrighted images without permission,
- impersonate another person,
- post discriminatory or illegal content,
- bypass website security,
- use the Platform for commercial advertising unrelated to housing,
- engage in scraping, data mining, or automated collection.
7. Intellectual Property
All platform design, text, logos, and features are owned by Hyde Park Marketplace.
Users retain ownership of their posted content but grant us:
a non-exclusive, royalty-free license to display, store, and distribute the content on the Platform.
8. No Warranties
The Platform is provided “as is” and “as available” without warranties of any kind.
We do not guarantee:
- listing accuracy or availability,
- identity or behavior of users,
- absence of errors, downtime, bugs, or security breaches.
Use of the Platform is at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law:
Hyde Park Marketplace is not liable for:
- rental disputes, evictions, damages, or financial loss,
- fraud, misrepresentation, or illegal activity by users,
- reliance on listing information,
- loss of data, service interruption, or technical issues.
Our total liability shall not exceed $100 or the amount you paid to use the Platform (currently $0).
10. Account Termination
We may suspend or delete an account that:
- violates these Terms,
- engages in fraud or misuse,
- posts illegal or harmful content.
11. Governing Law
These Terms are governed by the laws of Illinois, USA.
12. Changes to Terms
We may update these Terms at any time. Users will be notified by email or on the website.
